DAYTON, Ohio -- A judge in Ohio Monday declared a mistrial in the case of a Dayton mother accused of killing her infant daughter in a microwave oven.
China Arnold remains jailed in lieu of $1 million as she has been since November 2006 after Montgomery County Common Pleas Visiting Judge John Kessler ordered her case placed back on the docket for rescheduling, the Dayton Daily News reported.
The judge said there was new evidence in the case but declined to reveal the nature of the information.
While Arnold showed no emotion at the turn of events, her mother, Gloria Scot, expressed relief the two-week trial had ended.
"I'm just glad that this is over," she said. "We'll be ready for the next phase when it happens."
Arnold, 27, is charged with aggravated murder in the 2005 death of her 3-week-old daughter
"We are obviously disappointed, but we have every intention of retrying this case," said Greg Flannagan, spokesman for the Montgomery County Prosecutor's Office.
