HOUSTON, Tex. – A 19-year old driver is in custody after he slammed into a man who was exchanging information on the side of the freeway following a minor traffic accident, severing both of the victim’s legs and killing him instantly, authorities reported.

Marco Antonio Montya, 19, was arrested for various traffic violations and was detained pending blood test results to determine driver impairment, police said.

Houston Police Officers D.S. Schlichter and S.E. Holmes responded to the 10000 block of Interstate 45-North shortly before 6 a.m., Sunday, April 22 and found the victim, James Robert Magouirk, 19, deceased.

Preliminary investigation determined that Magouirk had been involved in a minor traffic accident, and was standing behind one of the vehicles on the side of the freeway, exchanging information with the other driver when he was struck and killed.

Houston Police Department Mobility Incident Management Division Sergeant L.A. Washington Jr. is continuing the investigation.
